Paid Sick Leave
for McCall Assignment Employees
OVERVIEW
The City and County of San Francisco Ordinance mandating Paid Sick Leave (PSL) for people who work in San Francisco went into effect February 5, 2007. McCall Staffing is in compliance with the Ordinance as described below:
Under The Ordinance:
- One hour of paid sick leave is accrued for each 30 hours worked on assignment to a maximum of 72 hours.
- These Paid Sick Leave (PSL) accruals start after a 90-day eligibility period.
- If you use some hours when you are at the maximum level, you begin re-accruing to fill up that 72-hour accrual "bank."
- In addition to use for yourself, the ordinance provides for a process of using your sick-leave accruals for family, registered partners or an other designated person.
More information about the ordinance is available at San Francisco Office of Labor Standards Enforcement. Feel free to call our payroll manager if you need further clarification.
McCALL EMPLOYMENT STATUS,
ACCRUAL & ACCRUAL RETENTION
The nature of temporary work, with "breaks in service" between assignments, has required us to develop a policy for purposes of PSL eligibility and accrual retention that distinguishes between Active/Employed status verses an Inactive/Terminated status.
Determining Employment Status:
Active/Employed: For the purpose of PSL, your are considered an Active Employed McCall Temporary Employee during the time you are actually working on a McCall assignment that is located within the City and County of San Francisco (the policy does not cover people who work on assignments outside of San Francisco).
Inactive/Terminated: A termination occurs at the end of each assignment. It remains in effect until such time as you are "re-hired" at the beginning of a new assignment, when you again become a McCall Active Employee.
Eligibilty and Paid Sick Leave Accrual:
Eligibility and Paid Sick Leave accruals only occur when you are Active employee on McCall Assignment in San Francisco. Accruals, whether eligibility phase or paid sick leave hours, are only earned when you are an active employee (i.e. on McCall Assignment). This means that you do not accrue sick leave or eligibility during the breaks between assignments.
Accrual Retention:
If you have completed the eligibility period and return for McCall reassignment after 30 days, you don't have to wait before beginning to accrue PSL, but you do have to start your PSL hour accruals again.
- Eligibility status is kept "on the books" for 4 years.
- Sick Leave Accruals are kept "on the books" for 30 days.
REPORTING ABSENCES
- CONTACT McCALL BY PHONE OR EMAIL
If you are out sick or taking Paid Sick Leave for a family member or designee, you must notify McCall to report time off from an assignment.
- HOW TO NOTIFY McCALL
- Call 415.981.3400.
- If you become ill outside of business hours, you may leave an after-hours message for your assignment supervisor. But, again, as the employer-of-record, McCall needs to be the company you first contact regarding the absence.
- If Paid Sick Leave eligible, please also send an email to
PSL@mccallstaffing.com
.
- REPORTING PAID SICK LEAVE HOURS IN ORDER TO GET PAID
- Paid Sick Leave should be taken in full hour increments.
- It MUST BE APPROVED by McCall in the week in which occurred.
- It MUST BR INCLUDED IN THE TIME CARD reporting for the week in which it occurred.
- FILLING OUT A TIME CARD FOR THE ASSIGNMENT WEEK DURING WHICH YOU WERE SICK
After you fill in the hours in our automated time card, you:
- print it out for client signature...BUT...
- write in the margin (to the right of where you would normally entered hours) when you are requesting PSL so that the client is aware of this payroll attribution.
- SICK LEAVE PAY CHECKS
When our payroll department receives your time card, we check to ensure that the absence was properly noticed before we check to see how much PSL accrual has been credited to you for payment.
- The Paid Sick Leave check will be a separate check from your payroll check (which will include appropriate tax and other pertinent deductions).
- These checks will NOT be a part of Direct Deposit. They will be here in our offices for your pick up or your instructions to have mailed.
- REALISTIC APPRAISAL OF YOUR ANTICIPATED RETURN TO ASSIGNMENT
Because the nature of temporary work is such that we may be requested to refill your assignment during your absence, we ask that you be prepared to let us know your best estimate of how long you think you will be out. We know that this will not be something "written in stone", but we do want to be able to tell a replacement temporary employee how long they might be needed as your assignment replacement.
- CONFIRMATION OF EXTENDED ILLNESS
We may require doctor confirmation of your condition if you are out for more than 3 consecutive days from an assignment or 5 days in a two week period.
